May. 2021 - Jun. 2023Cape Town, Western Cape, South AfricaThe South African Heritage Resources Agency (SAHRA) is an agency of the Department of Sport, Arts and Culture, tasked with an overall legislative mandate to identify, assess, manage, protect, and promote heritage resources (the national estate) in South Africa. Core role is that of in-house legal counsel, providing legal advice and support services to MANCO, EXCO and the organization at large, mitigating legal and compliance-based risks attached to business initiatives and operations, and providing legal representation, as and when necessary. Main activities include: - Corporate Governance and Company Secretarial duties. - Contract management and the drafting, negotiating and vetting of entity agreements/contracts/ legal documents including, but not limited to supplier agreements, SLA’s, MOU’s, heritage agreements, IP licensing agreements, data sharing agreements, confidentiality agreements, Public-Private Partnership (PPP) agreements, privacy notices, contravention notices, employment agreements, leases and sale agreements. - Assisting with litigious matters, including debt collection, evictions, commercial and contractual, labour related issues, and public law. - Providing sound legal opinions on operational matters and complex, high-level cases involving disputes around heritage resources. - Internal policy formulation and vetting. - Drafting of new regulations and legislative amendments, vetting and lodging of appeals to other government departments. - Risk management. - Property management. - Legal compliance e.g. creating a POPIA and PAIA legal compliance framework.
