Our services include: - The drafting, vetting or negotiating of contracts, policies, T’s and C’s and legal correspondence - Company Secretarial, POPIA and PAIA compliance services - In-house training and labour law - legal research, opinions and advice While we will conduct research and provide advice around a broad spectrum of law, Lay Law’s specialities lie with business law, the law of contract, IP, privacy and data protection, ICT, labour and property law. Lay Law also provides retainer services whereby we act as an outsourced or quasi in-house legal counsel for businesses at a discounted rate, but for a limited number of hours a month. This is far more affordable and efficient than hiring a full time in-house counsel as the service can be customised to specific operational and budget requirements. As a consultancy and not a law firm, Lay Law is not beholden to the rules, requirements and many expenses of traditional law firms so it means that, while we can’t conduct reserved work like litigation or conveyancing, we have much lower overheads and, thus, are able to have a very different and more transparent billing structure. Essentially, clients know what they are in for upfront which enables them to budget accordingly and receive a much greater value for money service than what would be provided by a traditional law firm.

Jul. 2023South AfricaThe Wireless Application Service Providers’ Association (WASPA) was formed in 2004 as a self-regulatory body with a mandate to represent and regulate its voluntary members, which provide mobile-based Value Added Services (VAS), otherwise known as WASPs. Membership of an industry body with a recognised Code of Conduct has been made compulsory by Telkom Mobile, Cell C, MTN and Vodacom for all WASPs. As well as representing the interests of WASPA’s members, WASPA plays a key role in regulating the provision of mobile applications and services in South Africa. WASPA’s Code of Conduct and Advertising rules were developed and implemented in 2005. It has developed a complaints handling process, to enforce these rules, that is totally independent of the WASPA Board. Anyone may lodge a complaint and each complainant is given a reference number. Complaints are handled by an independent secretariat who process complaints using a mandated civil procedure policy, while independent ICT lawyers and a 3-person appeals panel of ICT lawyers adjudicate the complaints lodged with the secretariat. An emergency panel of three WASPA adjudicators may sit to shut down offending services, pending a formal adjudication, where there is evidence of immediate and ongoing consumer harm. As one of these ICT lawyers, I adjudicate on matters related to the WASPA Code of Conduct where a complaint has been lodged. All completed adjudications are posted publically on the WASPA web site.
