Jun. 1997 - May. 2009Key Accomplishments: • Served as trial counsel for plaintiffs The Stop & Shop Supermarket Company and Walgreen Company in an exclusive dealing action brought in Rhode Island federal court against health care insurance companies, pharmacy benefits managers and pharmacies, resulting in the opening of a closed pharmacy network to allow prescriptions to be filled at plaintiffs’ stores. • Successfully defended Upsher-Smith Laboratories, Inc. against the Federal Trade Commission’s administrative lawsuit alleging unlawful agreement to delay entry of low-cost generic competition to a branded drug; the 11th Circuit upheld administrative law judge’s dismissal of the complaint, and the U.S. Supreme Court denied certiorari. • Drafted motions to dismiss on behalf of defendant ConocoPhillips Company in an antitrust case brought in federal court by 18 cities against producers of natural gas, alleging price fixing, monopolization and price discrimination in the sale of natural gas, resulting in the successful dismissal of the case. • Successfully represented Stolt-Nielsen Transportation Group, Ltd. in dismissing the Department of Justice’s criminal indictment of the company for alleged price-fixing in the chemical shipping industry; helped the company negotiate favorable settlements with customers. • Represented Royal Ahold, Raytheon Company, Houghton Mifflin Company, and other Fortune 100 companies in connection with Federal Trade Commission and Department of Justice antitrust reviews of various mergers and acquisitions.

Heinz Company in price-fixing class action alleging a 17-year conspiracy to fix the wholesale price of baby food, resulting in a favorable summary judgment ruling dismissing claims; affirmed by the 3rd Circuit Court of Appeals. • Served as second chair trial counsel in successfully defending Star-Kist Foods, Inc. and H.J. Heinz Company in a federal jury trial relating to the adoption of Star-Kist’s landmark “dolphin safe” tuna fishing policy, resulting in the dismissal of punitive and tort damage claims. • Represented Weight Watchers International, Inc. against the Federal Trade Commission in a false advertising investigation and administrative action brought by the agency and in a declaratory judgment action brought in federal court, forcing the agency to settle the case. • Defended Ashland Oil Company in a series of actions in various countries by the National Iranian Oil Company seeking to compel arbitration and/or recover $800 million in damages for failing to pay for crude oil purchased under letters of credit during the 1979 Iranian hostage crisis; case favorably settled prior to trial. • Successfully represented H.J. Heinz Company, Hershey Foods Corp., McDonnell Douglas Corp. and other Fortune 100 companies in connection with Federal Trade Commission and Department of Justice antitrust reviews of various mergers and acquisitions.
