Jun. 1997 - May. 2009Key Accomplishments: • Served as trial counsel for plaintiffs The Stop & Shop Supermarket Company and Walgreen Company in an exclusive dealing action brought in Rhode Island federal court against health care insurance companies, pharmacy benefits managers and pharmacies, resulting in the opening of a closed pharmacy network to allow prescriptions to be filled at plaintiffs’ stores. • Successfully defended Upsher-Smith Laboratories, Inc. against the Federal Trade Commission’s administrative lawsuit alleging unlawful agreement to delay entry of low-cost generic competition to a branded drug; the 11th Circuit upheld administrative law judge’s dismissal of the complaint, and the U.S. Supreme Court denied certiorari. • Drafted motions to dismiss on behalf of defendant ConocoPhillips Company in an antitrust case brought in federal court by 18 cities against producers of natural gas, alleging price fixing, monopolization and price discrimination in the sale of natural gas, resulting in the successful dismissal of the case. • Successfully represented Stolt-Nielsen Transportation Group, Ltd. in dismissing the Department of Justice’s criminal indictment of the company for alleged price-fixing in the chemical shipping industry; helped the company negotiate favorable settlements with customers. • Represented Royal Ahold, Raytheon Company, Houghton Mifflin Company, and other Fortune 100 companies in connection with Federal Trade Commission and Department of Justice antitrust reviews of various mergers and acquisitions.
