Dec. 2023 - Dec. 2024Employers are psychologically abusing workers, predominantly women and people of color, through such tactics as false accusations and sabotage, and anti-discrimination law isn’t enough to help them. - In the 80s and 90s, courts’ interpretation of anti-discrimination law moved from needing proof of impact to proof of intent, making it ineffective at disrupting the social hierarchies. People of color and women are still predominantly on the receiving end of mistreatment at work, but they can’t typically tie the mistreatment to their membership in a protected class. - The abuse results in a host of harms when workers are forced to choose between their health and a paycheck: a range of mental and physical problems from shame and self-blame to anxiety and depression to PTSD, suicidal ideation, and suicide. - The Workplace Psychological Safety Act falls in line with sexual harassment law, which says a hostile work environment is the baseline for legal recourse, and the target need not suffer from psychological injury. Gretchen Carlson, who sued Roger Ailes of Fox News, and Rowena Chiu, a #MeToo silence breaker who worked for Harvey Weinstein, testified with us in October 2023 along with roughly 40 experts verbally and hundreds in writing.
